Election phone calls

My neighbor called me and told me that he received FOUR phone calls this weekend shilling for Souder and The Republican Party. He told me two were people and two were automated...

I just got my first one at 7:36 PM the day before the election. It was from The Indiana Republican Party. It was not QUITE an automated call...

A live person asked me if I wanted to listen to an automated call from Laura Bush. I said "sure." Then I listened to Laura Bush shill for Republicans...

I am not sure if this makes the phone call legal or illegal...

My guess is that this call was legal bacuase it started with a live person...

Republican Attorney General Steve Carter is going to be involved in a lot of investigations of his own Party due to this election... I have a feeling he wishes that he had never said he would prosecute automated political phone calls in Indiana.

Does anyone know if the person in the beginning asking me if I wanted to listen to an automated phone call makes it legal in Indiana?

By the way ANOTHER neighbor told me they got one automated and one live call this weekend from the Republicans.

My mother-in-law who lives up the road got one automated phone call from the Republicans yesterday.

This does not sound like an isolated effort. Too many people are getting these calls... Steve Carter is going to be very busy investigating his own Party in the next couple of weeks...

I know that Republican Kevin Howell admitted today that his campaign purchased 3000 illegal calls in the 80th District...

I got the Laura call too.

I asked her for her daughter's phone number (Barbara not the skanky blonde), but she wouldn't answer.

If the live operator asks you if you want to hear the call, and you give your consent, then it is legal. I got the Laura call too.

The relevant statute is IC 24-5-14. It provides as follows:

A caller may not use or connect to a telephone line an automatic dialing-announcing device unless:

(1) the subscriber has knowingly or voluntarily requested, consented to, permitted, or authorized receipt of the message; or

(2) the message is immediately preceded by a live operator who obtains the subscriber’s consent before the message is delivered.

So, the live operator before the message makes it legal, provided the operator obtains your consent.

I figured that obtaining my consent made it legal; however, I was not sure.
